You Have the Right to Remain Silent

Many people know this right from television shows or movies where actors have been read their Miranda rights. However, you have the right to remain silent any time you are questioned by a law enforcement officer. This includes during a DUI stop. You do not have to say anything to the officer and you do not have to answer questions, even though you will likely be asked many.

You Do Not Have the Right to Deny the Officer Your Identifying Information or Vehicle Registration

When the officer asks for your license and registration, you must hand it to them. You do not have the right to deny the officer this information.

You Have the Right to Refuse Field Sobriety Testing

If the officer who pulled you over asks you to step out of the vehicle for a field sobriety test, you have the right to decline. You do not have to take a field sobriety test without penalty.

You Have the Right to Refuse Chemical Testing

A refusal of chemical testing means that your license will automatically be suspended for a period of time. It is typically in your best interest to go ahead and submit to chemical testing, however, you can refuse a breathalyzer and request a blood test instead.

You Do Not Have the Right to Resist Arrest

If you have been asked to step out of your vehicle and the officer has informed you that you are under arrest, you do not have the right to resist the arresting officer. Remain quiet and compliant and wait until you are able to contact your attorney.
